Flight Terms
Bookings: For issuing domestic air ticket, Smiles Holidays requires a time period of at least two (4) hours prior to the departure of flight in which the ticket is to be booked. For issuing international air ticket, smiles Holidays requires a time period of at least four (6) hours prior to the departure of flight in which the ticket is to be booked. For booking of international air ticket/s, You are required to submit all the requisite documents of the persons undertaking travel such as original valid ( 7 months validity of expiry date ) passport, copy of the visa (applicable as per the requirement of the country to which You are travelling) and other such documents as We may require as mandated by the Applicable Law. For booking of domestic air ticket, You are required to submit all the requisite documents of the persons undertaking the travel such as valid government photo identity proof (Voter ID Card/ PAN Card/ Driving License/ Aadhar Card etc.) and other such documents as We may require as mandated by the Applicable Law.
Terms of the Airlines: Smiles Holidays acts merely as a facilitator to enable you to book flight tickets. The airline tickets available on this Site are subject to the terms and conditions of the concerned airline in which tickets are booked, including but not limited to the cancellation and refund policies. The contract for the utilization of service shall always be between you and the concerned airline.
No Liability:
- Baggage allowance, meals, seat map, code-sharing, ok-to-board etc. will be as per the policy of the airlines in which the ticket is booked and Smiles Holidays has no control over such policies. Smiles Holidays shall not be liable if there are any changes in the policies of the airlines either prior to or after the booking of the air ticket is done.
- Check in: Usually the airport check-in begins 2 hours before the departure of the flight (Domestic journey) and 4 hours before the departure of the flight (in case of International journey) however You agree and understand that it is Your responsibility to check directly with the airlines regarding the check-in (including web check-in and airport check-in).
- Travel Documents: The User Understands and agrees that it shall be the responsibility of the User to be in the possession of the valid travel documents (including but not limited to visa, passport, government issued identity cards) in order to undertake the travel. Smiles Holidays shall not be in any way liable for lack of requisite travel documents due to which the User could not embark on an onward/ return journey.
Visa/ Okay -to -board/ other requisite permits: You agree and understand that booking of air tickets shall not automatically amount to the obtaining of visa/okay-to-board permits. You may avail our visa services which are provided by us (in the capacity of mere facilitator) which shall be offered as a separate service at a separate fee/charge.
Booking Fee: The total cost of the ticket (“Booking Fee”) shall be subject to the additional taxes as mandated by the Applicable Law.
Smiles Holidays Convenience Fees: In addition to the Booking Fee and taxes, Smiles Holidays charges an amount of Rs. 250 for domestic flights or one way flights and an amount of Rs 500 and Rs. 800 for round trip Flights Domestic and International respectively as ‘Smiles Holidays ‘convenience fee’ which shall be payable in full prior to the confirmation of the bookings.
Cancellations Terms:
1. Every booking made on the Site shall be subject to the cancellation terms/ cancellation policies/ rescheduling policy of respective airlines, which may vary according to various factors including but not limited to the type of the booking, flight, flight class, destination etc.
2. Online cancellations: Cancellations may be made by writing mail to : info@smilesholidays.in and message to number 9075018293 – entering Your PNR (Passenger Name Record) and other requisite details.
3. No Oral / Offline cancellations done by calling our office.
4. Cancellation Fee:
- Tickets up to 4000 will be totally non-refundable.
- Domestic flexi fares and corporate fares Rs 500 per person will be cancellation fees apart from regular cancellation of the air lines.
- International air tickets cancellation service fees will be Rs 1500 per person in addition to the cancellation of the air lines.
- Service chargers at the time of booking will be totally non-refundable.
- Date charges penalty as well as fare difference will be applicable.
- Tickets will be issued only after direct payment using credit/debit card/NEFT/UPI payment mode.
5. (For domestic c flights) per passenger for cancellation of each booking flights per passenger for cancellation of each booking. If Your booking involves 1 (one)/more connecting flight/s (“Sectors”), then each Sector will be considered as 1 (one) cancellation.
6. Time-period for cancellation: If Your request is made less than 3 hours of flight departure (for domestic flights)/ within 4 hours of flight departure (for international flights) as the case may be, You shall contact the airlines directly and Smiles Holidays shall not entertain/entertain any cancellation requests.
7. For cancellation of the tickets on which website check-in/telephone check-in is already done by You, You shall contact the airlines directly as Smiles Holidays does not entertain the requests for cancellation of the flight tickets on which website check-in/telephone check-in is done.
Booking Amendment Terms: For all requests for changes in flight booking/s You may contact us on: number provided on website (for requests via online mode)/ call us at office or write us at: info@smilesholidays.in (for requests via offline mode). Smiles Holidays charges a non-refundable fee of INR Penalty + Diff in fare+ Rs.500 for domestic flights/ an amount of INR Penalty + Diff in fare + Rs. 800 for international flights (Booking Amendment Fee) per passenger for each booking amendment which shall be payable by You at the time of making a request for amendments in Your booking. If Your request for amendment in flight bookings is less than 04 hours (for domestic flights)/ 24 hours (for international flights), Smiles Holidays does not entertain/ process any request/s for changes in bookings within these time-period.
Refunds and Returns: In case You require cancellation of the air ticket/s already booked on the Site, remaining Air ticket amount shall be refunded by us on repayment made by airlines after deducting our requisite cancellation charges and taxes if any. However, Our Convenience Fee and/or service charges are non-refundable and payable in any case.
Hotel Terms
Role of Smiles Holidays and No Liability of Smiles Holidays: Smiles Holidays acts merely as a facilitator to enable You to make hotel reservations. The hotel reservations available on this Site are subject to the terms and conditions of the concerned hotel in which reservation/s are made, including but not limited to the change of rooms, changes to existing booking after You check-in, cancellation and refund policies. The contract for the utilization of service shall always be between You and the concerned hotel.
The information/ content in the brochure is as provided by the hotel authority. Smiles Holidays shall not be liable for any information which false/ misleading/ inappropriate/ appropriate but not up to Your expectation. Additionally, Smiles Holidays shall not be liable for:
- Check-in allowed with delay.
- Change in rooms by the hotel authorities.
- Cancellation of reservation by the hotel.
- Misbehaviour from hotel authorities.
- Hotel authorities not providing facilities as promised including but not limited to breakfast, laundry, gym, spa, Wi-Fi ,Room service.
Smiles Holidays Fees: Smiles Holidays charges You an amount of Rs. 500 and more according to standard of hotel as ‘Smiles Holidays non-refundable convenience fee’ (per room per night each booking) which shall be payable in full by You before the confirmation of Your bookings.
Changes to existing bookings and Cancellation:
a) Every booking made on the Site for hotel shall be subject to the cancellation terms/ cancellation policies/ rescheduling policy of respective hotels, which may vary according to various factors including but not limited to the kind of reservation, cancellation when requested etc.
b) Online cancellations: Cancellations may be made by visiting : NOT APPLICABLE.
c) Offline Cancellations: Offline cancellations may be done by writing us at: info@smilesholidays.in
Booking Fee: The total cost of the stay at a hotel charged (per room and per night basis) (“Booking Fee”) and shall be subject to taxes as mandated by the Applicable Law.
Cancellation Fee: In addition to the cancellation fees charged by the hotels, Smiles Holidays charges an amount of Rs. 500 cancellation fee per room per night for cancellation of each booking. Time-period for cancellation: No request for cancellation/ changes to existing bookings shall be entertained by Us, if the booking is under zero cancellation. Request you to check the cancellation policy before confirmation.
Refunds and Returns: In case you require cancellation of the hotel reservations already booked on the Site, remaining amount of the Booking Fee shall be refunded by us on repayment made by hotel after deducting Our requisite cancellation charges and taxes if any. However, Our Convenience Fee and/or service charges are non- refundable and payable in any case.
Additional Charges by the hotel: In addition to the Smiles Holidays convenience fee and the charges levied by the hotel for Your hotel booking, You may be required to pay (upon Your check-in into the hotel) certain amount to the hotel/ deposit Your credit card as ‘Security Deposit’ which would enable the hotel authorities to deduct charges for any additional service You make subscribe to/ for the loss/ damage of hotel property. Such payments are not included in the Booking Fee Your sole responsibility and Smiles Holidays assumes no liability of whatsoever kind.
Booking Amendment Terms: For all requests for changes in hotel reservations You may contact us at: info@smilesholidays.in (for requests via online mode)/ call Us at office (for requests via offline mode). Smiles Holidays charges a non-refundable fee of INR Rs.250. (“Booking Amendment Fee”) per room per night for each booking amendment which shall be payable by You at the time of making a request for amendments in Your booking. If Your request for amendment in hotel reservation/s is less than 72 hours, Smiles Holidays does not entertain/ process any request/s for changes in bookings beyond these time-period
Land Transfer
“Land Transfer” shall mean and include the services offered by Smiles Holidays in the capacity of mere facilitator for travel of passengers from the moment they get off the flight till the time they board the flight.
“Private Car Hire” shall mean and include the services of car hire as facilitated by Smiles Holidays be entering into engagement with the private car hire companies.
Role of Smiles Holidays and No Liability: Smiles Holidays as a facilitator only provides You with the access to the services of land transfer and private car hire services by Independent Service Providers (as defined in the clause ‘Tour Package). You agree and acknowledge that by accessing Our Site and subscribing to the services of Land Transfer / Private Car Hire (as the case may be), You are entering into a contract with the Independent Service Providers who register/s with Us for providing the services of Land Transfer/ Private Cab Hire in which scenario neither Smiles Holidays nor its associates, directors, personnel, officers shall have any control over such services. You by subscribing to the services of aforementioned Independent Service Providers, further agree to be bound by the terms and conditions regarding such services.
Booking Fee: The total cost of the bookings for services of Land Transfer and/or Private Car Hire (“Booking Fee”) shall be subject to the additional taxes as mandated by the Applicable Law.
Smiles Holidays Fees: Smiles Holidays charges you an amount of Rs. 1000 as ‘Smiles Holidays non-refundable convenience fee’ (per passenger per each booking) which shall be payable in full by You before the confirmation of Your bookings.
Rescheduling and Cancellation: Every booking made on the Site shall be subject to the cancellation terms/ cancellation policies/ rescheduling policy of respective cab operator/s, which may vary according to various factors including but not limited to the type of the booking, type of car, time of cancellation request, destination etc.
In addition to the cancellation fee charged by the cab operator/s, Smiles Holidays charges a cancellation fee of INR Rs. 1500 for cancellation of each booking. Time-period for cancellation: If Your request for cancellation is made less than 48 hours of cab service/s going to be availed by You, one day charge will be applicable.
Refunds and Returns: In case You require cancellation of the bookings for Land Transfer/ Private Car Hire already booked on the Site, remaining amount of the Booking Fee shall be refunded by Us on repayment made by cab operators who provide the services of Land Transfer/ Private Car Hire after deducting Our requisite cancellation charges and taxes if any. However, Our Convenience Fee and/or service charges are non- refundable and payable in any case.
User Responsibilities: In case of Private Car Hire (abroad), You agree to obtain International Driving Permit/s (IDP) which could be a requirement for driving abroad as per the applicable law/s in that country and to carry original documents such as IDP, Indian driving license, passport, visa and any other documents as mandated by the Applicable Law/s. If a country (You are visiting abroad) has any specific mandate as per their applicable law/s requiring You to obtain special permission from the local authorities in such country in addition to the documents that You are required to have in Your possession, it shall be Your sole responsibility to obtain such permission/s or approvals and You agree that Smiles Holidays shall not be liable in case of any breach/ non-observance/ violation by You of such special conditions as mandated by their applicable law/s.
In case of Private Car Hire (in India), you agree to carry original documents such as driving license and any other document/s as mandated by the Applicable Law/s.
Terms of Visa Services
Your Duties in the Visa Application Process: It shall be Your duty to provide Smiles Holidays with original and valid passport and all other necessary documents, original and/or attested copies, as and when required by Smiles Holidays and/or its third party agents according to Applicable Laws, and any other additional documents and information for processing visas as may be required by the authority for approval. It is Your duty to ensure that all visa application forms shall be completed and signed by You before they are handed over to Smiles Holidays for processing of visa.
In case there is a requirement of travel insurance from any authority for approval, Smiles Holidays shall inform the same to You and You shall provide Your travel insurance to Smiles Holidays at the time of providing the documents as mentioned above. If You do not have travel insurance, Smiles Holidays shall issue the travel insurance policy and You are liable to pay the prescribed amount as well as Smiles Holidays service charges for the same, as communicated by Smiles Holidays
If the documents required for visa processing, as asked for by Smiles Holidays , are not received by Smiles Holidays as and when asked, or if the documents submitted by You are incomplete, it may result in rejection or delay in the approval of visas and in such case Smiles Holidays shall not be held liable for such rejection or delay.
Smiles Holidays requires a period of at least 3 working days for processing and transmitting the documents to the authority for approval. The visa processing time varies from country to country and the decisions are made on the credentials of the documents submitted in support with the application.
Role of Smiles Holidays and No Liability: The final decision of the approval of visa is of the authority for approval. Smiles Holidays acts merely as an intermediary between the You and the authority for approval for facilitating the process of visa application. Smiles Holidays does not have the power to influence the authority for approval to reduce the time for processing the visa application and/or to influence acceptance or rejection of the visa application and You should not request or pressurize Smiles Holidays for the same. Smiles Holidays shall not be liable in case the visa is rejected or its approval is delayed for any reason whatsoever.
Smiles Holidays being a facilitator shall not be held liable for:
a) In case of rejection of visa (with/ without assigning any reasons), Smiles Holidays shall not be held liable.
b) In case of delays caused by the authority in the approval process of visa, Smiles Holidays shall not be held liable.
c) The authority may grant the validity of visa for a limited time period or for a specific purpose, in such cases Smiles Holidays shall not be liable for limited validity of visa. In such cases, if the User desires to reschedule his/her travel, then such User shall apply again for visa services which shall be at extra charge payable and to be borne by the User.
d) The visa granted by the authority may contain errors which shall include without any limitation spelling mistakes, wrong address or contact information. In such cases, the User shall not undertake travel as per the Applicable Law. The User shall reschedule his/ her journey, by applying again for visa approval which shall be considered as a separate service offered at additional cost payable by the User.
Smiles Holidays Visa Fee: For visa processing, the following amounts (collectively referred to as ‘Smiles Holidays Visa Fee’) shall be payable by You in advance:
a) All costs at actual for application fees, courier charges and other services provided by Smiles Holidays to You;
b) Visa application fees as charged by the authority for visa approval on the day the visa application is submitted to the authority for approval.
c) Smiles Holidays visa fee for the services provided by Smiles Holidays to You, as shall be communicated by written means to You by Smiles Holidays ;
Smiles Holidays Visa Fee shall be paid by You, as per the invoice raised by Smiles Holidays , at the time of submitting the requisite documents to Smiles Holidays . Smiles Holidays shall forward the documents submitted by You to the high commission/ foreign embassy only when the Smiles Holidays Visa Fee has been paid in full by You.
No Refund: Smiles Holidays does not provide any refund on the fee charged for visa services. If in case of any refundable security deposit paid to the authority in the process visa approval, such security deposit shall only be refunded when We receive such security deposit from the authority.
Tour Packages
“Brochure” means catalogue, leaflet, e-mail or any other document containing the details about the itinerary and activities on a Tour in India/ abroad.
“Independent Service Provider/s” means hotelier or hotel owner, owner of any airline/s or shipping company, ferryboat owner, tour operator, cab operator/s, bus operator/s or any other Person with whom Smiles Holidays enters into an engagement in the capacity of mere facilitator.
“Tour” means a tour made available by Independent Service Provider/s whether within India or abroad and includes, but is not limited to, tours, special tours, packages, cruise, sightseeing, carnival, star cruise etc.
“Tour Cost” means total booking cost of all the services booked by the User for his/her Tour.
“Smiles Holidays Convenience Fees” means a non-refundable fee or token money deposited at the time of booking by User.
Role of Smiles Holidays and No Liability: Smiles Holidays does not own/ control/ operate any airline, hotel, shipping company, transport vehicles, restaurant, kitchen caravan or any other service mentioned in the Brochure.
Smiles Holidays acts merely as a facilitator to enable You to subscribe the services of the Independent Service Provider/s. The bookings done on the Site for subscription of services in the Tour package which are provided by the Independent Service Provider/s shall be subject to the terms and conditions (including but not limited to the cancellation and refund policies) of each of the Independent Service Provider/s who is/are providing services in the Tour package.
For example You subscribe a Tour package whether within India or abroad and it involves the services of flight booking/s, bus Tour, land transfer, hotel, sightseeing as a package, then in such scenario the bookings done by You on Our Site shall be subject to the terms and conditions of all the Independent Service Providers such as terms and conditions of hotel, airline, cruise/shipping, land transfer, bus separately as You by booking the service of Tour package on Our Site are entering into a contract of utilization of service with each of the Independent Service Provider/s to which Smiles Holidays will not be a party and Smiles Holidays by merely facilitating Your access to the services by the Independent Service Provider assumes no liability in any case whatsoever.
Smiles Holidays being a mere facilitator shall not be liable for the following:
a) Personal injury, sickness, death, accident, discomfort, increased expenses, loss and/or damages (incidental/ consequential/ direct/ remote), theft caused to You or any other person travelling with You.
b) Any act, omission, default of any travel agent, Tour manager or third party or any other Person or by any agent employed by them.
c) Any delay made/ default on the part of any of the Independent Service Providers.
d) The temporary/permanent loss of, damage to, baggage or personal belongings in the Tour due to the negligence of any Independent Service Provider/s.
e) Any failure on the part of the airline to: Accommodate passengers despite having confirmed tickets due to overbooking, change in routes, any other reason whatsoever. Depart on time due to which You have suffered any medical illness, injury or failure of any part of the body.
f) Failure on part of the hotel to allow check-in despite having valid reservation for whatsoever reason.
g) Any claim arising due to delay at airport and if You have to wait at the airport due to the airline cancellations/ rescheduling/ due to any technical snag.
Meals and Special Requests: Whenever there is mention of meals in plan, the menus are pre-set by the Independent Service Provider/s for the Tour package. The nature of the meals is clearly indicated in the Brochure. Smiles Holidays shall entertain a request for a special meal but never give it guarantees about the same
Tour Cost: The total cost shall include the price/s of all the services as included in a Brochure. The User agrees and understands that the price and taxes as mentioned in the Brochure towards ‘Tour Cost’ is/are only indicative in nature and may be changed by the Independent Service Providers/ Smiles Holidays as per the increase in the market value.
Smiles Holidays Convenience Fees: In addition to the, Smiles Holidays charges an amount of INR Rs. 3500 per person which shall be payable in full prior to the confirmation of the bookings.
Cancellation Terms: Every booking made on the Site shall be subject to the cancellation terms/ cancellation policies/ rescheduling policy of each of the Independent Service Provider/s, which may vary according to various factors including but not limited to the kind of service, kind of booking etc.
Online Cancellations: Not applicable.
Offline Cancellations: Offline cancellations may be done by writing us at: info@smilesholidays.in
Time-period for cancellation: No refund shall be possible if Your request is made less 7 days from the Tour.
